There is no charge to website visitors or prospective clients for accessing the website or submitting an inquiry through the Firm's online intake Services.

2. No Attorney-Client Relationship Created by Website Use

Accessing this website, submitting an intake form, sending a text message, participating in an online chat, emailing the Firm, or otherwise communicating with Powell Law Firm does not, by itself, create an attorney-client relationship between you and the Firm or any of its attorneys.

An attorney-client relationship is established only when Powell Law Firm has agreed to represent you and the Firm and client have completed any engagement process required by the Firm, including execution of an applicable written representation agreement.

You should not rely on the submission of an inquiry as confirmation that Powell Law Firm represents you.

Until an attorney-client relationship has been established, you remain responsible for protecting your own legal rights, including complying with any statutes of limitation, notice requirements, filing deadlines, court deadlines, or other time-sensitive obligations.

3. No Legal Advice Through General Website Content

Information appearing on the Firm's website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as legal advice concerning any particular situation.

Do not assume that Powell Law Firm has agreed to represent you unless the Firm expressly confirms that representation has been accepted.

5. Confidential and Sensitive Information

We recognize that prospective clients may provide sensitive information when seeking legal assistance.

However, because an attorney-client relationship is not necessarily created merely by submitting information through the website, you should avoid submitting highly sensitive information unless reasonably necessary for the Firm to evaluate your inquiry.

If you become a client, communications and information associated with the representation will be handled in accordance with the Firm's professional obligations and applicable law.

The Firm's collection, use, storage, and disclosure of personal information through its website and intake systems are also governed by its Privacy Policy.

6. Text Message and Electronic Communications

Consent to Communicate

When you voluntarily provide your mobile telephone number to Powell Law Firm and affirmatively request or consent to communication by text message, you authorize the Firm and service providers acting on the Firm's behalf to communicate with you at that number regarding your inquiry, potential case, intake process, appointments, requested information, and, if you become a client, communications relating to your legal matter.

Communications may be transmitted using automated technology or a web-based messaging platform.

Consent to receive text messages is not a condition of hiring Powell Law Firm or receiving legal services from the Firm.

Types of Messages

Depending upon your interaction with the Firm, messages may include:

  • Responses to your request for information;
  • Intake questions;
  • Requests for documents or additional information;
  • Appointment confirmations and reminders;
  • Follow-up regarding an incomplete inquiry;
  • Notifications concerning documents requiring review or signature;
  • Communications concerning your potential or active legal matter; and
  • Other communications reasonably related to your relationship or requested interaction with the Firm.

Message Frequency and Charges

Message frequency will vary depending upon your interaction with the Firm.

Message and data rates may apply depending upon your wireless carrier and mobile service plan. Powell Law Firm does not charge you for receiving text messages from the Firm, but your wireless carrier may impose charges.

Carriers are not liable for delayed or undelivered messages.

Opting Out

You may withdraw your consent to receive text messages at any time.

You may reply STOP to a Firm text message to request that text communications cease. We may also recognize other language that reasonably communicates your request to stop receiving text messages.

After receiving an opt-out request, we may send a one-time message confirming your request.

Opting out of text messaging does not terminate an attorney-client relationship, if one exists, and does not prevent the Firm from communicating with you through other appropriate methods when necessary or permitted by law.

You may contact the Firm if you wish to update your communication preferences.

You may reply HELP to a Firm text message for assistance or contact Powell Law Firm using the contact information provided on our website.

Your Responsibilities

By providing a mobile number, you represent that you are authorized to receive communications at that number.

If your telephone number changes or is reassigned, you should promptly notify the Firm.

You should not use text messaging for emergencies or matters requiring immediate attention. If you believe you are experiencing an emergency, contact the appropriate emergency service.

7. Attorney Advertising and Solicitation

Communications from Powell Law Firm are intended to comply with applicable laws and rules governing attorney advertising, solicitation, and professional conduct.

Nothing contained in these Terms authorizes the Firm, its attorneys, employees, agents, vendors, or technology providers to communicate with prospective clients in a manner prohibited by applicable law or the Missouri Rules of Professional Conduct.

The Firm's use of automated technology, text messaging, online intake systems, or other communication tools does not alter its professional obligations as a law firm.

8. Third-Party Technology Providers

Powell Law Firm may use third-party technology providers to operate portions of its website, intake process, messaging services, document systems, scheduling systems, analytics tools, or other Services.

When appropriate, information you provide may be processed by these providers on the Firm's behalf for purposes related to providing the Services.

Use of third-party technology does not authorize those providers to provide legal advice or establish an attorney-client relationship with you.

Third-party services may also be subject to their own privacy policies and terms.

9. Electronic Communications Are Not Guaranteed to Be Secure

Electronic communications involve risks beyond the Firm's complete control.

Although Powell Law Firm uses reasonable safeguards appropriate to the information and systems involved, no website, email system, text messaging service, mobile network, or Internet-based communication platform can be guaranteed to be completely secure, continuously available, or error-free.

You acknowledge that electronic communications may be delayed, misdirected, intercepted, unavailable, or affected by circumstances outside the Firm's control.

If information is particularly sensitive, you may contact the Firm to discuss an alternative method of communication.

10. Medical and Health Information

Personal injury inquiries may require prospective clients to provide information concerning injuries, medical treatment, medical providers, insurance, or related health information.

Information you voluntarily provide through the Firm's intake systems may be used to evaluate your potential legal matter and, if representation is established, to provide legal services.

Powell Law Firm's receipt of medical or health-related information does not make the Firm a healthcare provider and does not mean that every health-related communication or record transmitted to the Firm is governed by HIPAA.

Where applicable, the Firm and its service providers will handle protected or confidential information in accordance with applicable legal and professional obligations.

11. Conflicts of Interest

Submission of information through the Services does not mean that Powell Law Firm is able to represent you.

Before accepting a matter, the Firm may need to determine whether representation would create a conflict of interest or otherwise be inappropriate.

You should not interpret an automated response, text message, intake conversation, scheduling confirmation, or preliminary discussion as confirmation that the Firm has completed its conflict review or accepted your case.

12. No Guarantee of Response or Case Acceptance

The Firm attempts to respond promptly to inquiries but does not guarantee that every inquiry will receive an immediate response.

Automated acknowledgments or messages indicating that information has been received do not constitute acceptance of your case.

If you have a time-sensitive legal matter, you should not rely exclusively on electronic submission or messaging to protect your rights.

13. Prohibited Uses

You agree not to use the Services to:

  • Violate applicable law;
  • Submit information you know to be materially false or fraudulent;
  • Impersonate another person or misrepresent your identity;
  • Harass, threaten, abuse, or unlawfully interfere with another person;
  • Transmit malware, viruses, malicious code, or other harmful technology;

POWELL LAW FIRM DISCLAIMS WARRANTIES REGARDING THE OPERATION OR AVAILABILITY OF THE WEBSITE AND ONLINE TECHNOLOGY SERVICES EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

Nothing in this section limits professional duties that Powell Law Firm owes to a client once an attorney-client relationship has been established.

23. No Waiver

Failure by Powell Law Firm to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

24. Entire Agreement Regarding Website Use

These Terms and the Privacy Policy constitute the agreement between you and Powell Law Firm concerning your use of the public website and online intake Services.

These Terms do not replace or modify any engagement agreement, fee agreement, settlement authorization, representation agreement, or other agreement entered into between Powell Law Firm and an actual client.

If there is a conflict between these Terms and an executed client representation agreement concerning the Firm's legal representation of a client, the applicable representation agreement controls with respect to the representation.
